Our Agreement
This agreement is a legal document which sets out:

(a) the customer's ( hereafter 'You' ) rights and obligations
(b) those of The Artist(s) you are buying from.
(c) those of Peeled Eye Shop, in relation to services offered by the Artist(s) through this website.

When you register your details on this website, you agree to the terms of this agreement, and you re-affirm that agreement every time you use this website's services.

If you purchase a product from this website you are entering into a contractual agreement with Peeled Eye Shop, who will handle the transaction and are responsible for the technical functionality of this website, and the Artist, who is responsible for delivering the goods you have paid for in a in a satisfactory and timely manner. All verbal representations of the Artist's work on this website shall remain the responsibility of the Artist. Peeled Eye Shop will operate a 10 day returns policy (see below).

Governing Law
This Agreement is made under and shall be construed in accordance with English Law. This includes (without limitation) all contractual and other relationships, which arise as a result of transactions between you and us on this website. In the event of a dispute, all parties agree to submit to the exclusive jurisdiction of the relevant court located in London, England.

Checking Out
For your confidence and total security, all our online financial transactions are handled by Worldpay®, which is one of the largest global online payment processing systems. Our simple checkout procedure means you can review and edit the contents of your shopping basket before you place your order. You must have cookies enabled in your web browser (see Privacy Policy below) to return to your shopping basket and review its contents if you leave the checkout area without placing an order for any reason. If cookies are disabled this feature will not work, and your basket will be empty when you return.

Privacy policy
The privacy policy forms part of the agreement between us, and by purchasing from this website you agree to be bound by this agreement. You also consent to the way in which we use your personal data as explained in this policy statement:

When you place an order on the Website, we consider the information you input as private. The information we keep is protected from outside parties. We use the information only for the following purposes:

• processing your orders
• for statistical purposes to improve the Website and its services to you
• to serve site content
• to administer the Website. We may also contact you, with your permission, in respect of special offers or competitions.

Neither the Artist or Peeled Eye Shop will use this data, or disclose it to any other party, either during registration or at any other time, without your permission. We may, however, disclose this data if compelled to do so by law, or in response to a valid request from a law enforcement or government agency.

A cookie is a text file on your hard disk that Web sites use to store information about you and your preferences for the site. We use cookies to keep track of your current shopping session, to personalise your experience, and so that you may retrieve your shopping cart at any time.

Transactions
Neither the Artist or Peeled Eye Shop are privy to your credit card details. You agree to register for sales using your correct name, address and any other requested details. You will be asked to enter credit, debit or charge card details. You must ensure that you are fully entitled to use that card at the time when you provide those details to Worldpay®, and when you use the card, that funds are available to cover all charges incurred on it in the course of buying from us. You must be over 18 years old.

Tax & Duties
If the Artist is registered for Sales Tax (VAT), purchase prices quoted on the website may include a sales tax component if applicable. Please note that when importing goods, customers may be liable for duty charges levied by their own country. Customers are solely responsible for any duty owed.

Corrections
Descriptions of goods and services included on the Artists website are accurate to the best of our knowledge. We will correct errors or omissions as soon as we are aware of them. However, you should be aware that the colours and appearance of images may vary slightly from the way they appear on the screen. This is due to the fact that different computer screens will represent colour, contrast and brightness with slight variations depending on how they have been calibrated.

Usage
These images are licensed for indoor display purposes only and ARE NOT licensed for commercial purposes. However, it may be possible to license some images through a commercial picture library or directly from the Artist. If you're interested in licensing an image, you must contact Peeled Eye Shop who will ask the Artist for further information on availability and/ or usage fees.

Returns Policy
It is important to us that you feel absolutely confident about our service. So we offer a simple, no-quibble guarantee. If for any reason you're not delighted with your purchase, simply fill in the returns form enclosed and return the item to us in its original packaging within 10 days of receipt under the Distance Selling Regulations Act 2000. We will either fully reimburse you, replace the print, or exchange it for any other one of your choice. This guarantee does not affect your statutory rights.

Copyright
Any contravention of copyright will be prosecuted. The copyright on all work displayed on this site belongs to the Artists under English law. Under no circumstances can any material be reproduced either in digital or printed form without prior written permission from the Artist. You may not use, reproduce, modify or distribute any image, or any part of those images on this website, in any unauthorised manner whatsoever. The graphic designs on any PeeledEye PrintBox website are the property of Peeled Eye Shop. The gallery walls concept remain the intellectual property of Peeled Eye Shop. Any overt plagiarism of the PeeledEye PrintBox both in form and/ or content shall be deemed a contravention of intellectual copyright. Peeled Eye Shop®, Printbox® and Peeled Eye Artbox® are registered trademarks.

Loss and liability
Under no circumstances whatsoever will Peeled Eye Shop or the Artist be responsible or liable to you or any other entity for any loss of data, profit, revenue (including lost profits and lost business opportunities), or special, exemplary or punitive damages , howsoever caused.
Neither Peeled Eye Shop or the Artist shall be liable for any failure to perform their obligations under this agreement if caused by matters beyond our reasonable control.
This does not affect your statutory rights as a consumer.

Severability
If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, then the remaining provisions will nevertheless remain in full force and effect. All parties agree to negotiate in good faith a substitute, valid and enforceable provision which most nearly affects the parties intent upon entering this Agreement.

Changes to this Agreement
Peeled Eye Shop reserve the right to change the terms of this agreement from time to time, and post a new version on the website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.
